Drunk driving penalties for CMV drivers

Whenever alcohol enters the system, alteration of focus, concentration and mental clarity begin to occur. The New York Department of Motor Vehicles claims that alcohol can cause jerky starts and improper passing as well as preventing drivers from staying in their lanes. Drunk drivers also commonly run red lights and fail to use signals. Even at low blood alcohol concentration levels, drivers may be less alert and find that their vehicle operation skills are impaired.


For drivers who are traveling in commercial motor vehicles, the penalties for drunk driving are even worse than for those in passenger vehicles. The large size of commercial trucks and possibility of dangerous cargo means that more attention to proper driving techniques is needed. While most drivers can be cited for drunk driving if their BAC surpasses 0.08 percent, truck drivers are held to a lower limit of 0.04 percent.


Monetary fines and other penalties can also be greater for drivers who are operating under a CMV license. License suspensions and revocations of a few months to several years can be issued, making it impossible for truck drivers to continue working and earning a livelihood. In addition to this penalty, a fine of anywhere from a few hundred to a few thousand dollars can be charged.


Truck drivers who become repeat offenders will face more aggressive charges with each citation. They will also be punished more severely if their BAC falls into a higher bracket of intoxication levels. In some cases, prison time can be assigned as a penalty.
